Conditions of participation – Zugerland Contests
General information
The Zugerland Shopping Center, Hinterbergstrasse 40, 6312 Steinhausen (hereinafter referred to as the "Organizer") is holding a competition under the title stated in the competition during the predefined period.
Participation is free of charge (apart from the usual communication costs) and independent of the conclusion of a purchase contract.
Conditions of participation
Natural persons resident in Switzerland aged 18 and over are eligible to participate. In the case of competitions for children, e.g. drawing competitions, no age restrictions or the age restrictions defined in the competition apply. Only one entry per person is permitted. Employees of Zugerland Shopping Center and persons/companies involved in the competition, automated services and professional/commercial participants are excluded from participation.
Closing date
The closing date stated in the competition applies to the competition. To take part in the corresponding competition, participation must be completed by 11.59 p.m. (CET) on the day of the closing date.
Prizes / Determining the winners / Notifying the winners
The prize is stated in the competition. The winners are not entitled to cash redemption, exchange, modification or supplementation of the prize. Unless otherwise stated in the competition, the prizes must be collected from the Zugerland shopping center.
Unless otherwise stated in the competition, prizes will be drawn at random and will not be made public. The winners will be notified in writing. If the prize is not collected within the period defined in the correspondence, the organizer may award the prize to another participant who has been selected in accordance with the provisions of these conditions of participation.
If the prize is handed over in person, the participant agrees to the handover of the prize being documented. The image/sound material may be used by the organizer for advertising purposes in any form, including mentioning the name of the winner.
Data protection
Participants' personal data will be used in accordance with the Swiss Data Protection Act. If photos, audio or video recordings of the participants are used as part of the competition, the participants confirm by participating that they hold all rights, in particular all copyrights to the data and images of their recording. Furthermore, participants confirm that they agree to the publication of the recording on the organizer's online channels and allow the organizer unrestricted use of the recordings and - to the extent permitted by law - transfer all rights in connection with these recordings to the organizer.
The participants have no right to publication by the organizer. The organizer reserves the right not to publish recordings. The participants transfer all rights to their recording to the organizer (to the extent permitted by law). The organizer may use the recording for any purpose and may also allow third parties to use it in whole or in part. The organizer is not obliged, but is entitled, to mention the participants when using the recordings. He is entitled to attach his own copyright notice when using the recordings.
The personal data of the participants will be stored in a database of the organizer. They may be used for PR and advertising purposes. No data will be passed on to third parties.
Further provisions
The organizer accepts no liability for any transmission errors, loss of data, in particular during data transmission and other service disruptions due to technical defects.
The organizer reserves the right to exclude participants from the competition due to false information, manipulation or the use of unauthorized aids. The organizer further reserves the right to change or discontinue the competition or these conditions of participation at any time without notice and without giving reasons at its own discretion and/or to replace/cancel the prizes. The organizer declines all liability in such cases.
There will be no correspondence about the competition apart from the notification of the prize. Legal recourse is excluded.
The organizer has organized the competition in good faith and cannot be held liable for damages of any kind or origin in connection with participation in this competition, including the allocation of prizes and the subsequent consumption, redemption or use of the prizes themselves.
These conditions of participation are governed exclusively by substantive Swiss law. Should individual provisions of the conditions of participation be or become invalid, this shall not affect the validity of the remaining provisions. All disputes relating to these conditions of participation or the competition shall be subject to the exclusive jurisdiction of the competent courts at the organizer's registered office.
